Pit Reporter & Live Streaming Terms

IMPORTANT: By using Pit Reporter or any live streaming feature on racer.wiki, you agree to these additional terms in full. These terms apply to all reporters, viewers, and anyone whose image may be captured by a live stream.

1. What Pit Reporter Is

Pit Reporter is a user-generated live video streaming feature that allows Black Book users to broadcast real-time video from racing events โ€” pits, grandstands, or trackside โ€” using their mobile device. Streams are transmitted via WebRTC (WHIP/WHEP protocol) through Cloudflare Stream and are viewable by other Black Book users. Recordings are automatically retained for 30 days on Cloudflare's servers before deletion.

2. Your Consent Obligations as a Reporter

You are solely responsible for obtaining all legally required consents before streaming.

Before you go live, you must:

  • Comply with all federal, state, and local laws regarding video recording of individuals in public and semi-public spaces. Many states have specific wiretapping, eavesdropping, and recording consent laws. Some states require consent of all parties being recorded.
  • Comply with any media, recording, or photography policies posted or enforced by the track, venue, or event promoter. Many tracks prohibit unauthorized streaming or commercial video use. You are responsible for checking with the promoter before going live.
  • Avoid streaming individuals who have not consented to being filmed, particularly in private areas such as enclosed pit spaces, garages, or locker rooms.
  • Never stream minors without express consent of a parent or legal guardian.
  • Comply with any sanctioning body (IMCA, WoO, DIRTcar, etc.) rules regarding media and streaming rights at their events.

G10be does not obtain these consents on your behalf. G10be does not verify that you have obtained them. By activating a live stream, you represent and warrant that you have all necessary consents and rights to stream.

3. Prohibited Content

You may not stream any content that:

  • Depicts or facilitates illegal activity
  • Includes sexually explicit material
  • Constitutes harassment, stalking, or targeting of specific individuals
  • Captures minors in any context without explicit parental consent
  • Infringes on the intellectual property rights of sanctioning bodies, promoters, broadcasters, or other rights holders (including track-owned broadcast rights)
  • Captures private conversations without the consent of all parties in jurisdictions requiring it
  • Depicts active emergency situations in a manner that impedes emergency response
  • Is intentionally defamatory toward identifiable individuals

4. Accidents and Safety Incidents

If you are witnessing or are involved in an active safety emergency, stop streaming and render or call for assistance immediately. Streaming takes second priority to human safety at all times.

G10be strongly discourages the live streaming of serious accidents, crashes involving injuries, or emergency response operations. We reserve the right to terminate any stream depicting such content without notice.

5. G10be's Right to Terminate Streams

G10be reserves the right to terminate any live stream, with or without prior notice, that we reasonably believe:

  • Violates any provision of these terms
  • Violates applicable law
  • Infringes on a third-party's rights
  • Creates legal, reputational, or safety risk for G10be, the Black Book platform, or other users

Termination of a stream does not necessarily result in account suspension, nor does it guarantee that a violation has occurred โ€” we may act out of an abundance of caution.

6. Data Collected by Pit Reporter

G10be does not store personally identifiable viewer data. We do not record which specific accounts watched any particular stream. Viewer presence is counted but not identified.

7. Cloudflare as Video Processor

All live video is transmitted through and stored on Cloudflare Stream infrastructure. Cloudflare's data processing terms apply to this data. Cloudflare's servers may be located outside the United States. By using Pit Reporter, you consent to this international data transfer for the purpose of live stream delivery. Recordings are automatically deleted from Cloudflare 30 days after a stream ends.

G10be does not maintain separate long-term video archives. After 30 days, the recording cannot be recovered by G10be or Cloudflare.

8. DMCA / Copyright Safe Harbor

G10be operates as a passive conduit for user-generated live streams. We do not pre-screen, curate, or editorially control stream content. In accordance with 17 U.S.C. ยง 512 (DMCA), G10be is a service provider hosting user-generated content.

If you believe a live stream or recording infringes on your copyright, contact us at support@inkwell.wiki with the following:

  • Identification of the allegedly infringing stream or recording (stream ID or URL)
  • Description of the copyrighted work you believe is being infringed
  • Your contact information and a statement of good faith belief
  • A statement under penalty of perjury that the information is accurate
  • Your physical or electronic signature

We will respond to valid DMCA takedown notices within 10 business days.

9. Viewer Responsibilities

As a viewer of live streams:

  • You may not record, capture, rebroadcast, or redistribute any live stream content without the express permission of both G10be and the original reporter.
  • You acknowledge that content is user-generated and that G10be does not endorse, verify, or warrant the accuracy of anything said or shown in a live stream.
  • You acknowledge that live racing involves inherent danger and that streams may depict crashes, injuries, or other disturbing events without warning.

10. Disclaimer of Liability for Stream Content

G10BE EXPRESSLY DISCLAIMS ALL LIABILITY FOR THE CONTENT OF USER-GENERATED LIVE STREAMS. G10be is a technology platform, not a broadcaster or media company. We do not employ reporters, direct stream content, or supervise what is captured.

G10be is not liable for: any claims arising from video recordings of individuals without proper consent; any sanctioning body, promoter, or venue policy violations by reporters; any copyright or intellectual property claims arising from streamed content; any defamation claims arising from statements made during live streams; or any personal injury, property damage, or legal liability resulting from actions taken or not taken in response to viewing a live stream.

11. Indemnification

By using Pit Reporter as a reporter, you agree to indemnify, defend, and hold harmless G10be, its officers, directors, employees, and agents from any claims, damages, losses, costs (including reasonable attorneys' fees), and liabilities arising from: your live stream content; your violation of these terms; your failure to obtain required consents; or any third-party claims related to your use of Pit Reporter.
